At OZ Communications Inc. (“OZ”) we are committed to protecting your privacy, and support a general policy of openness about how we collect, use and disclose your personal information.  “Personal information” is any information that identifies you as an individual. This Privacy Statement applies to personal information related to end-users of OZ’s mobile products, those individuals who contact OZ directly via phone, email or mail and those individuals who give us personal information through our website. 
This Privacy Statement does not apply to third-party online resources to which the web sites of OZ may link, where OZ does not control the content or the privacy practices of such resources.  This Privacy Statement also does not apply to information regarding OZ’s corporate customers or partners. Nor does it apply to the personal information of employees. However, such information is protected by other OZ policies and practices, and through contractual arrangements.
OZ is a software company with offices in Canada, the United States, the UK and India. This Privacy Statement applies in Canada.

OZ designs and licenses software that allows mobile phone users to access their email, instant messaging, and social networking services (their “Communications Services”) from their mobile phones.  Our customers are mobile phone manufacturers and mobile operators (the “Mobile Providers”) who license our software and install it on the mobile phones they sell to their end-customers (the “End Users”). 

Our software translates and transports your communications between your mobile phone and your Communications Services (like Yahoo!, Windows Live Messenger, or AIM). For example, when you read an email that your friend has sent to your Yahoo! email account on your mobile phone using the OZ Email Solution, OZ’s software has done three things: It has opened your email account and retrieved the message, and it has transported that message from the Internet, through the OZ gateways, to your mobile phone. When you send a reply, OZ Email Solution has transported your message from your mobile phone over its gateways to your Communications Service provider, then accessed your account and deposited the message.

Though your communications pass through the OZ gateways, OZ does not access your personal information when you send communications using OZ Mobile products. The only personal information related to your message that OZ keeps is what we call ‘Traffic Data,’ such as your phone number, the time the message was sent or received, and the size of the message. In other words, your communication travels across our network like a letter through the mail. We maintain records about what we can see on the outside of the letter – its size, the mailing and return to sender address and the date over the stamp.  The actual contents of your communication are stored on the servers of your Communications Services provider.
In very limited circumstances, OZ may be asked by the Mobile Provider to access user e-mails in order to resolve a service or technical support issue.  We limit these circumstances to only those that are necessary to address the service issue and we agree with the Mobile Provider not to use this information for any other purpose, and to retain the information for only as long as is necessary to resolve the service issue.
In addition to the above, OZ may collect personal information that is voluntarily provided by individuals who contact OZ directly through email, phone or mail. This information could include:

• Contact information (including name, address, telephone number and e-mail address in a non-business capacity); and
• Details about your use of the OZ Mobile products and any problems you are having.

OZ processes the Personal information that you transmit with your mobile phone on behalf of your Mobile Provider and does not have a direct relationship with End Users.  As a result, OZ relies on the consent you give to your Mobile Provider for the limited use by OZ of your Personal information to provide the OZ services.
In the event that we need to use your Personal information for a purpose other than those identified in this Privacy Policy, we shall seek your consent prior to such use.
The form of consent that we seek, including whether it is express or implied, will largely depend on the sensitivity of the Personal information and the reasonable expectations of the individual in the circumstances. 
You may withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice.  If you wish to withdraw your consent at any time, please contact Chief Privacy Officer at +1 (514) 390-1333 or CPO@oz.com.  We will inform you of the implications of withdrawing consent.

We will not, as a condition of the supply of our services to you, require you to consent to the collection, use or disclosure of information beyond that required to fulfill the explicitly specified and legitimate purposes for which the information is being provided.

When you visit our website, we place a text file called a “cookie” in the browser directory of your computer’s hard drive.  A cookie is a small piece of information that a website can store on your web browser and later retrieve.  The cookie cannot be read by any website other than the one that set up the cookies.  Some browsers can be set to reject all cookies.  If you choose to modify your browser in this manner, some pages of this website may not function properly/your experience on this website will not be affected.

OZ takes steps to ensure that Personal information collected from you or to which we have access is protected against unauthorized access.  This protection applies in relation to information stored in both electronic and hard copy form, including traffic data and information collected through the website and the customer service desk.

OZ uses VPNs and a restricted-access database to protect your communications as they pass through our gateways.  Any information stored by OZ, including your traffic data is protected by firewalls, access control procedures and cryptography capabilities, to protect Personal information against unauthorized access. We limit access to traffic data and any Personal information our Mobile Providers instruct us to examine to address a service issue to those who require access to perform their duties.

The OZ website may offer links to other third party websites.  You should be aware that operators of linked websites may also collect your Personal information (including information generated through the use of cookies) when you link to their websites. OZ is not responsible for how such third parties collect, use or disclose your Personal information, so it is important to familiarize yourself with their privacy policies before providing them with your Personal information.

The communication itself, including Personal information, is stored on the OZ gateways or on your mobile phone.  We retain your Traffic Data for an entire billing period, or as long as required by your particular Mobile Provider for research and service quality purposes. We maintain our files regarding customer service and website inquiries for as long as required by your Mobile Provider.

OZ’s web site is a general audience web site. We do not specifically collect information from children. If we do become aware that information collected is from a child under the age of 13, we will ask for the consent of a parent or guardian before filling, using or disclosing that information. We will not knowingly use or disclose children’s Personal information unless parental/guardian consent is obtained.

OZ reserves the right to modify this Privacy Statement at anytime. We will notify web site users that changes have been made to the privacy policy for 30 days following a substantive change.  Privacy Statement posted at any time or from time to time via this website shall be deemed to be the Privacy Statement then in effect.

You have a right to access your Personal information collected directly by OZ, except in limited circumstances. You may access Traffic Data about you by contacting your Mobile Provider or OZ, although OZ will respond to such requests at the direction of the Mobile Provider.
